The 19^th City Council held its 17^th Regular Session on May 4, 2022 wherein the following legislative measures were enacted on Third and Final Reading, viz:

Ord. No. 0948-22	An Ordinance authorizing the City Mayor to sign, for and in behalf of the City of Davao, the Airtime Agreement for the program “Byaheng Do30” to be entered into by and between the City of Davao and GMA Network, Inc. Mindanao from January 1, 2022 until December 31, 2022
Ord. No. 0949-22	An Ordinance granting legislative authority to the Supplemental Budget No. 02, of the City Government of Davao, for Calendar Year 2022, consisting of the General Fund Proper, the Development Fund and the Economic Enterprises, in the amount of One Billion Seventy-Eight Million Four Hundred Twenty-Two Thousand Seven Hundred Fifty-Six Pesos and 40/100 (P1,078,422,756.40), as amended
Ord. No. 0950-22	An Ordinance for the establishment of Davao City Rice Processing Center, that includes Post-Harvest Facilities, Providing Subsidies, Incentives and other Support for Palay Farmers in the City of Davao

Moreover, Resolution No. 03467-22 and its Ordinance were approved on Second Reading, amending Ordinance No. 0105-19, Series of 2019, to be known as “The Amended Annual Financial Assistance to all Qualified Senior Citizens Ordinance of Davao City”.

The Body likewise approved Resolution No. 03468-22 and its corresponding Ordinance on Second Reading, granting authority to the City Mayor to enter into and sign, the Memorandum of Agreement (MOA) to be entered into by and between the City of Davao and the Cacao City Marketing Cooperative relative to the establishment and operation of the Chocolate Hub located at the Ground Floor of the Investment and Tourism Building, J. Palma Gil Street, this City until December 31, 2022.

During the discussion of the items considered urgent under Suspended Rules, Resolution No. 03471-22 with Ordinance No. 0952-22, Series of 2022, were approved authorizing the City Mayor to enter into and sign, for and in behalf of the City of Davao, the Memorandum of Agreement by and between the City of Davao and the National Economic Development Authority (NEDA) – Regional Office XI, relative to the release of funds for the formulation of the Metropolitan Davao Public Safety and Security Master Plan (MDPSSMP).

Lastly, Resolution No. 03472-22 with Ordinance No. 0953-22, Series of 2022, were also approved authorizing the City Mayor to enter into and sign, for and in behalf of the City of Davao, the Renewal of the Memorandum of Understanding (MOU) to be entered into by and between the City of Davao and the Philippine National Police (PNP) – Police Regional Office (PRO) XI relative to the decontamination of the RT-PCR Molecular Diagnostic Laboratory located inside Camp Sgt. Quintin M. Merecido, Buhangin, this City.

During the 16^th Regular Session held on April 26, 2022, the 19^th City Council passed and approved on Third and Final Reading, Ordinance No. 0934-22, Series of 2022, entitled “An Ordinance declaring Davao Chong Hua High School as Historical Landmark in Davao City”.

The Body likewise passed Resolution No. 03453-22, Series of 2022 and its corresponding Ordinance on Second Reading, granting legislative authority for the City Mayor to sign, for and in behalf of the City of Davao, the Airtime Agreement to be entered into by and between the City of Davao and GMA Network, Inc., particularly the airing of the Program Byaheng Do30.

Moreover, Resolution No. 03454-22, Series of 2022 and its corresponding Ordinance on Second Reading, were also approved adopting Supplemental Budget No. 2, for Calendar Year 2022, of the City Government of Davao, consisting of the General Fund Proper, the Development Fund and the Economic Enterprises, as amended.

Through the sponsorship of Councilor Ralph O. Abella, the Body adopted Resolution No. 03455-22, Series of 2022 and its corresponding Ordinance on Second Reading, relative to the establishment of Davao City Rice Processing Center, that includes Post-Harvest facilities, Providing Subsidies, Incentives and other Support for Palay Farmers in the City of Davao.

Ordinance No. 0932-22, Series of 2022, was approved by the19^th City Council on Third and Final Reading, relative to the Deed of Usufruct to be entered into by and between Mark Raphael Tabin and Carlos K. Chan and the City of Davao, relative to the use of Three (3) meter width roadway within the Two-hundred Nineteen (219) square meter lot, more or less, covered by TCT No. T-207667, situated in Barangay Cabantian, Buhangin, this City, to be used as entrance and exit gate of Co Su Gian Home for the Aged and CIC-Balay Dangupan under the administration of the City Social Welfare and Development Office (CSWDO), for Twenty-five (25) years.

Resolution No. 03447-22, Series of 2022, was likewise passed and approved by the Body on Second Reading, strongly recommending to the City Treasurer’s Office (CTO) to suspend the implementation of Section 348 of the Revenue Code of Davao City applying a common rate in the market rental fees per day of the meat, chicken and fish sections in all markets and in all levels and to apply the old rates.

Resolution No. 03448-22, Series of 2022 with its Ordinance on Second Reading was aprroved, declaring the Davao Chong Hua High School as Historical Landmark in the Davao City.

During the 14^th Regular Session held on April 12, 2022, the 19^th City Council passed and approved Resolution No. 03436-22, Series of 2022 closing item No. 1597 relative to “Resolution No. 27, Series of 2021 of the Barangay Council of 17-B, Poblacion District, this City, requesting the Sangguniang Panlungsod of Davao City for the suppression of the road particularly the portion of Cervantes Street from corner Loyola Street to corner Nidea Street, consisting of an area of 700 square meters, more or less, to be utilized as permanent barangay site of Barangay 17-B and to deny the said request for road suppression per recommendation of the City Planning and Development Office (CPDO)”.

The Body also approved Resolution No. 03437-22, Series of 2022 closing item No. 1694, re: Ms. Cherry Ann K. Melencion, RSW, OIC, Acting Asst. Center Manager/MDOOII, Davao City Treatment and Rehabilitation Center for Drug Dependents, relative to the Memorandum of Agreement between the City of Davao and the Dangerous Drugs Board, Central Office, to finance the construction of the Outpatient and After Care Building amounting to Ten Million Pesos (P10,000,000.00), and the passage of Sangguniang Panlungsod Resolution endorsing the said project for reasons that per the Dangerous Drug Board, the budget requested cannot be made available.

 

Resolution No. 03438-22, Series of 2022 with its Ordinance, on Second Reading was likewise approved, authorizing the City Mayor to sign, for and in behalf of the City Government og Davao, the Deed of Usufruct to be entered into by and between Mark Raphael Tabin and Carlos K. Chan, represented by Victoria San (owner) and the City of Davao, relative to the parcel of land being used as entrance and exit gate of Co Su Gian Home for the Aged and CIC-Balay Dangupan under the administration of the City Social Welfare and Development Office (CSWDO) for twenty-five (25) years.

Further, the Body approved Resolution No. 03424-22, Series of 2022, with its corresponding Ordinance on Second Reading, enacting an Ordinance amending Ordinance No. 0291-17, Series of 2017, otherwise known as “The 2017 Revenue Code of Davao City” particularly Section 348, applying a common rate in the Market Rental fees per day of meat, chicken and fish sections and granting a thirty-five percent (35%) decrease in such rates for all classes of Markets in Davao City.

Resolution No. 03426-22, Series of 2022, and the corresponding Ordinance on Second Reading, were likewise approved relative to the Memorandum of Agreement (MOA) to be entered into by and between the City of Davao and Smart Communications, Inc., for the installation of Smart Telecommunication facilities with a Microcell Solution Deployment at Magsaysay Park, this City.

Another Resolution was approved on Second Reading through Resolution No. 03425-22, Series of 2022, declaring compliance of the City Government of Davao to DILG-ARTA-DOE Joint Memorandum Circular No. 2021-0 prohibiting the levy of fees and taxes on inter-province transport of goods or merchandise, regulatory fees in local ports, and other additional taxes, fees or charges in any form.

The following legislative measures were adopted under the Suspended Rules, to wit:

On March 22, 2022, the 19th City Council passed and approved on Third and Final Reading, Ordinance Nos. 0907-22 and 0908-22, both Series of 2022, authorizing the City Mayor to sign the Memoranda of Agreements (MOAs) with the Department of Agrarian Reform (DAR), the Bridges Management Cluster-Unified Project Management Office (BMC-UPMO) of the Department of Public Works and Highways (DPWH), and DPWH Regional Office XI, relative to the construction of Marapangi Bridge with installation of a double lane unibridge structure in Marapangi, Toril and Purok 9 Bridge in Barangay Sirawan, Toril, all of Davao City, under the Tulay ng Pangulo para sa Kaunlarang Pang Agraryo Project (TPKP), respectively.

Moreover, Ordinance No. 0909-22, Series of 2022, was approved on Third and Final Reading relative to the Memorandum of Agreement (MOA) by and between the City of Davao and the Department of Social Welfare and Development (DSWD) Region XI, for the adoption of the Yakap Bayan Program in the City of Davao.

Ordinance No. 0910-22, Series of 2022, was likewise passed and approved on Third and Final Reading, authorizing the City Mayor to sign the Memorandum of Agreement (MOA) with the Department of Health (DOH), for the disbursement of funds used by the City for the grant of Meals, Accommodation, and Transportation (MAT) benefits to qualified Health Care Workers (HCWs) covering the period September 15, 2020 to December 19, 2020.

Meanwhile, the Body approved Resolution No. 03415-22, Series of 2022 and its corresponding Ordinance on Second Reading, entitled “Enacting an Ordinance further amending City Ordinance No. 0218-09, Series of 2009, otherwise known as the “Davao City Parks System Ordinance” particularly Section 12 thereof by amending sub-paragraphs xii, xiii and adding a new provision, to be designated as sub-paragraph xx.

These provisions shall now read as follows:

“B. Prohibited Acts. To ensure the proper management and maintenance of all public parks, adopted parks or street-islands or green spaces and green stips, the following acts shall be prohibited, to wit:

Further, sub-paragraph xx is hereby added to Section 12, paragraph B which shall be read as follows

The Body also approved Resolution No. 03419-22, Series of 2022, authorizing the City Mayor to sign the Memorandum of Agreement (MOA) with PHIX Genomics for the establishment of the Genomics Laboratory in Davao City.

During the Suspension of the Rules, the following legislative measures were approved, to wit:

With Councilor Alberto T. Ungab as the Temporary Presiding Officer of the 10^th Regular Session held on March 8, 2022, the 19^th City Council passed and approved on Third and Final Reading, Ordinance No. 0899-22, Series of 2022, entitled “An Ordinance to Effect the Collection of Five Hundred Pesos (P500.00) Socialized Fees in relation to the Implementation of Republic Act 11222, otherwise known as the “Simulation of Birth Rectification Act”, as recommended by the City Social Welfare and Development Office”.

Likewise, the Body approved during the privilege hour were Resolution No. 03385-22, Series of 2022, espoused by Councilor Pilar C. Braga, expressing the 19^th City Council’s solidarity to the Women of Davao City in celebration of Women’s Day and Women’s Month and Resolution No. 03386-22, Series of 2022, urging the Civil Service Commission (CSC) to include the Sangguniang Kabataan (SK) Councilors/Kagawads in the grant of Barangay Official Eligibility (BOE).

Also approved on Second Reading through the sponsorship of Councilor Ralph O. Abella, was Resolution No. 03389-22, Series of 2022, entitled “Resolution to enact an Ordinance amending Ordinance No. 1457, Series of 1974, entitled “An Ordinance prohibiting the loosening or letting stray dogs in the City of Davao, providing for the catching and impounding of the same, collection of fees for impounding them and providing further for their disposition when not claimed within a certain period and providing for penalty in case of violation thereof”.

Under Suspended Rules, the Body approved Resolution No. 03387-22 with its corresponding Ordinance No. 0900-22, both Series of 2022, authorizing the City Mayor to sign, for and in behalf of the City of Davao, the Deed of Donation to be executed by and between Give A Textbook Foundation and the City of Davao relative to the donation of books for the Australian Corner at the Davao City Library.

Finally, Resolution No. 03388-22 and its corresponding Ordinance No. 0901-22, both Series of 2022, were also passed under Suspended Rules, authorizing the City Mayor to enter into and sign, for and in behalf of the City of Davao, the renewal of the Terms and Conditions for the use of DepEd School, particularly Sta. Ana Central Elementary School, by the Local Government Unit as a Temporary Quarantine or Isolation Facility of Last Resort.

During the 9^th Regular Session held on March 2, 2022, the 19th City Council approved on Third and Final Reading, Ordinance No. 0897-22, Series of 2022, entitled “An Ordinance Regulating the Maintenance of Idle Poles and Abandoned Wires and Cables in the City of Davao”.

Ordinance No. 0898-22, Series of 2022, was likewise approved on Third and Final Reading amending Ordinance 0384-10, otherwise known as “Organic Agriculture Ordinance of Davao City 2010.”

Further, Resolution No. 03377-22, Series of 2022, “Enacting an Ordinance to Effect the Collection of Five Hundred Pesos (P 500.00) Socialized Fees in Relation to the Implementation of Republic Act 11222, otherwise known as the “Simulation of Birth Rectification Act” as recommended by the City Social Welfare and Development Office”, was approved.

The Body likewise favorably endorsed the project: Construction of City Disaster Risk Reduction Management Office Building as one of the priority programs of the City Government of Davao through Resolution No. 03379-22, Series of 2022.

Under Suspended Rules, Resolution No. 03380-22, Series of 2022, was adopted urging all Government, Private and Educational Institutions to encourage COVID-19 Booster Doses for workers and students.

Resolution No. 03381-22, Series of 2022, entitled, “Strengthening the Indigenous Peoples Education Program (IPED) Pursuant to Department of Education Order No. 62, Series of 2011 to Provide Basic Education that is Responsive to the Context, Respects the Identities, and Promotes the Values of the Indigenous Knowledge, Skills, and Other Aspects of the Cultural Heritage of Indigenous Cultural Communities/Indigenous Peoples (ICCs/IPs) of Davao City, was also approved.

Lastly, Resolution No. 03384-22, Series of 2022, was also approved under Suspended Rules providing for Special Rules Pro Hac Vice while under the State of Calamity as determined by law for the conduct of the Regular and Special Sessions of the Davao City Council.

Supplemental Budget No. 1 of the City Government of Davao, for Calendar Year 2022, consisting of the General Fund Proper, the Development Fund and the Economic Enterprises, in the total amount of Four Hundred Nineteen Million Seven Hundred Eighty-Seven Thousand One Hundred Seventy-Four Pesos and 76/100 (PhP 419,787,174.76) was approved during the 8^th Regular Session of the 19th City Council held on February 22, 2022 through Ordinance No. 0890-22, Series of 2022.

The Body likewise passed on Third and Final Reading, Ordinance No. 0891-22, Series of 2022, creating the City Peace 911 Council and Peace 911 Sa Barangay, subject to all laws and existing legal rules and regulations.

Ordinance No. 0892-22, Series of 2022, was also enacted granting the request of Richard Ragasa, District Engineer, Department of Public Works and Highways, for the temporary road closure to pave way to the construction of the project, “Construction of Drainage Structure along Daang Maharlika Highway (MN) K1510+610, this City”.

Under Business for the Day, Resolution No. 03367-22, Series of 2022, and its corresponding Ordinance were also approved and its corresponding Ordinance on Second Reading, regulating the maintenance of idle poles and abandoned wires and cables in the City of Davao.

Resolution No. 03366-22, Series of 2022, and its Ordinance on Second Reading amending Ordinance 0384-10 otherwise known as “Organic Agriculture Ordinance of Davao City 2010”, was duly approved and adopted by the Body.

Resolution No. 03347-22, Series of 2022, granting legislative authority to the proposed Supplemental Budget No. 1 of the City Government of Davao, for Calendar Year 2022, consisting of the General Fund Proper, the Development Fund and the Economic Enterprises, in the total amount of Four Hundred Nineteen Million Seven Hundred Eighty-Seven Thousand One Hundred Seventy-Four Pesos and 76/100 (PhP 419,787,174.76).

The Body likewise passed on Second Reading Resolution No. 03351-22, Series of 2022, creating the City Peace 911 Council and Peace 911 Sa Barangay, subject to all laws and existing legal rules and regulations.

Moreover, Resolution No. 03354-22 with its Ordinance No. 0880-22, Series of 2022, were adopted under Suspended Rules authorizing the City Mayor to sign the Terms of Partnership with the Department of Health (DOH) Center for Health Development Davao, relative to the citywide implementation of the Annual Operation Plan for the Year 2022.

Four separate Ordinances were approved under Suspended Rules allowing the City Mayor to sign the Loan Agreements with the following Cooperatives: Subasta Integrated Farmers Multipurpose Cooperative, Tibungco Transport Cooperative, Lamdag Multipurpose Cooperative, Kalamboan Sa Katawhan Credit Cooperative, and under the Enhanced Livelihood and Enterprise Assistance Program of the Cooperative Services Support Program (CSSP)-Cooperative Financial Assistance Program (CFAP) of the City, through Resolution Nos. 03356-22, 03357-22, 03358-22 and 03359-22 with its corresponding Ordinance Nos. 0881-22, 0882-22, 0883-22 and 0884-22, all Series of 2022, respectively.

Lastly, Resolution No. 03363-22, Series of 2022, was adopted under Suspended Rules giving authority to the City Mayor to sign the Memorandum of Agreement (MOA) with the Consulate General of the People’s Republic of China in Davao, relative to the Undertaking of the Donation and Distribution of Seedlings, Fertilizers, and Pesticides amounting to Three Million Five Hundred Thousand Pesos (PhP 3,500,000.00) from the Consulate General of the People’s Republic of China in Davao to identified Davao City Banana – Cardava Farmers.
